These Terms govern your use of the Sophie / SB Resort mobile app (the "App"), operated by South Beach Resort ("we," "us"). By creating an account or using the App, you agree to these Terms and to our Community Guidelines. If you do not agree, please do not use the App.
The App is intended for guests and staff of South Beach Resort. You must be at least 13 years old to create an account. You are responsible for your account and for all activity that happens under it. Keep your login credentials secure and let us know if you suspect unauthorized use.
You keep ownership of the photos, videos, and text you post. By posting, you grant South Beach Resort a non-exclusive license to store and display that content within the App to the audience you choose (Everyone or your Crew). You are responsible for what you post and confirm you have the right to share it. Do not post content you don't own or that violates someone's privacy.
You agree to follow the Community Guidelines, including the zero-tolerance policy for objectionable content and abusive behavior. You agree not to misuse the App, interfere with its operation, attempt to access other users' accounts, or use it for any unlawful purpose.
We may review, remove, or restrict content, and suspend or disable accounts, that violate these Terms or the Community Guidelines — including immediate removal of objectionable content and offending users. We may also discontinue features or the App at any time.
Photos and videos you upload are stored using a third-party cloud storage provider. The App also shows public weather information and offers an AI assistant ("Ask Sophie"). These features are provided for convenience and may not always be accurate.
The App is provided "as is," without warranties of any kind. Weather, activity, and AI-assistant information may be inaccurate or unavailable. To the fullest extent permitted by law, South Beach Resort is not liable for any indirect or incidental damages arising from your use of the App.
If you obtained the App from the Apple App Store, your use is also subject to Apple's Licensed Application End User License Agreement.
We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.
